Welcome to Crisp3D. These Terms of Service (“Terms”) govern your access to and use of the Crisp3D website, applications, AI generation tools, community features, and related services (collectively, the “Service”).
The Service is operated by NEXLIMIT LLC, a company registered in the United States (“Crisp3D,” “we,” “us,” or “our”).
By accessing or using Crisp3D, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
1. Eligibility
You must be legally capable of entering into an agreement to use Crisp3D.
If you are under the age of legal majority in your country or region, you may use the Service only with the permission and supervision of a parent or legal guardian.
If you use Crisp3D on behalf of a company or another organization, you confirm that you have the authority to accept these Terms on its behalf.
2. Accounts
Some Crisp3D features may require an account.
You agree to:
- Provide accurate and current account information.
- Keep your login credentials secure.
- Take responsibility for activity conducted through your account.
- Notify us if you believe your account has been accessed without authorization.
You may not sell, transfer, share, or make your account available to another person in a way that violates your plan or these Terms.
We may suspend or restrict accounts involved in fraudulent activity, misuse of the Service, payment disputes, security risks, or violations of these Terms.
3. The Crisp3D Service
Crisp3D provides AI-powered tools for creating, processing, editing, viewing, and sharing 3D content and related media.
Features may include text-to-3D generation, image-to-3D generation, texturing, model processing, previews, downloads, community galleries, and other creative tools.
We may add, change, limit, suspend, or discontinue features as the Service develops. The availability and usage limits of individual features may depend on your account or subscription plan.
4. Your Input
“Input” means the prompts, images, 3D files, text, reference materials, and other content you submit to Crisp3D. You retain any ownership rights you have in your Input.
By submitting Input, you confirm that:
- You own the Input or have the necessary rights and permissions to use it.
- Your Input does not violate another person’s intellectual property, privacy, publicity, or other legal rights.
- You have obtained any required permission from identifiable people appearing in your Input.
- Crisp3D may process the Input as necessary to provide the requested Service.
You are responsible for the Input you submit and for determining whether you have the right to use it.
5. Generated Content
“Output” means 3D models, textures, images, previews, animations, and other content generated or processed through the Service.
As between you and Crisp3D, you retain any rights you may have in your Output, subject to applicable law, third-party rights, your subscription plan, and these Terms.
Commercial Use
Paid plans include a commercial license. Subject to your compliance with these Terms, you may use Outputs generated under a paid plan for personal and commercial projects, including games, films, animations, advertising, product visualization, 3D printing, and other commercial applications.
Commercial use rights apply to Outputs generated while the applicable paid plan is active. Because Output is generated using artificial intelligence:
- Similar or identical content may be generated for other users.
- Output may contain errors, unexpected details, or technical limitations.
- Crisp3D cannot guarantee that every Output is original or free from third-party rights.
- Output may not qualify for copyright or other intellectual property protection in every country.
- You are responsible for reviewing an Output before using, publishing, selling, printing, or distributing it.
A commercial license does not grant you rights in third-party content contained in your Input or Output. You remain responsible for obtaining any permissions required for your intended use.
6. Public and Private Works
Works generated through the free plan are public by default and may appear in Crisp3D’s public gallery, discovery pages, community features, or other areas of the Service.
Users on an active paid plan may choose whether their generated works are public or private, subject to the options available within the Service.
When a work is public, you grant Crisp3D a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and promote that work in connection with operating and promoting the Service. This permission allows Crisp3D to display public works on Crisp3D pages, community galleries, social channels, promotional materials, and similar Service-related locations.
If a public work is removed or made private, Crisp3D will stop using it for new promotional purposes within a reasonable period. Copies may remain temporarily in backups, cached pages, existing posts, or records retained for legal and operational purposes.
Crisp3D may remove, restrict, or refuse to display public content that violates these Terms or may cause harm to Crisp3D, its users, or third parties.
7. Storage and Retention of Works
Works generated under a free plan are generally stored for six months from the date of generation. After that period, they may be deleted and may no longer be recoverable.
Works generated while a paid subscription is active are stored without a scheduled expiration date for as long as the subscription remains active.
If a paid subscription is canceled, expires, or is downgraded to a free plan, works generated during the paid subscription will enter a six-month retention period beginning on the date the paid plan ends. After that period, the works may be deleted.
You are responsible for downloading and maintaining your own backup copies of important works. We cannot guarantee that content will always remain available if it is removed for legal, security, technical, or policy reasons. Additional information about account and personal data retention is provided in our Privacy Policy.
8. Crisp3D Content and Technology
The Service, including its software, website design, branding, interfaces, models, systems, documentation, and underlying technology, is owned by or licensed to NEXLIMIT LLC and is protected by applicable intellectual property laws.
These Terms give you a limited, non-exclusive, non-transferable, and revocable right to access and use the Service in accordance with your plan. They do not give you ownership of Crisp3D’s software, technology, trademarks, branding, or other platform materials.
You may not copy, sell, license, modify, distribute, or commercially exploit any part of the Service except where expressly permitted by Crisp3D.
9. Acceptable Use
You may not use Crisp3D to:
- Violate any applicable law or regulation.
- Infringe another person’s intellectual property, privacy, publicity, or other rights.
- Create or distribute unlawful, fraudulent, abusive, threatening, hateful, exploitative, or seriously harmful content.
- Create sexual or exploitative content involving minors.
- Impersonate another person or create deceptive content intended to cause harm.
- Upload malware, malicious code, or content intended to disrupt the Service.
- Gain unauthorized access to another account, system, or network.
- Reverse engineer, extract, copy, or attempt to discover restricted parts of the Service or its underlying technology.
- Use automated systems to access the Service in a way that creates excessive load or bypasses usage restrictions.
- Resell or provide unauthorized access to the Service.
- Use the Service or its Outputs to develop or train a competing AI model or service without our written permission.
- Circumvent safety systems, usage limits, content filters, payment systems, or account restrictions.
We may review, restrict, remove, or report content when reasonably necessary to enforce these Terms, protect users, comply with law, or maintain the safety of the Service.
10. Plans, Credits, and Usage Limits
Crisp3D may offer free plans, paid subscriptions, credits, one-time purchases, or other forms of access. The features, prices, credit amounts, usage limits, expiration rules, and other conditions applying to a plan will be shown on the relevant pricing page, checkout page, or within the Service.
Credits:
- May be required to use certain generation or processing features.
- Have no cash value.
- Cannot be transferred between accounts unless Crisp3D expressly allows it.
- May expire according to the conditions displayed when they are granted or purchased.
We may update plans, prices, features, and usage limits. Changes affecting an existing paid subscription will normally apply from a future billing period unless immediate changes are required for security, legal, or technical reasons.
11. Payments and Subscriptions
When you purchase a subscription, credits, or another paid feature, you agree to pay the price and any applicable taxes shown at checkout. Payments may be processed by third-party payment service providers. Their terms and privacy practices may also apply to your payment transaction.
If a subscription automatically renews, the applicable billing period, renewal terms, and price will be presented during purchase. You authorize the applicable third-party payment service provider to charge your selected payment method for each renewal until the subscription is canceled.
You may cancel a subscription using the options available in your account or by contacting us. Unless otherwise stated, cancellation takes effect at the end of the current paid billing period, and access to paid features continues until that date. Failure to complete a payment may result in the restriction, downgrade, or suspension of paid features.
12. Refund Policy
You may request a subscription refund within three calendar days after the subscription takes effect, provided that no more than 100 credits have been used.
Refund requests submitted after the three-day period, or after more than 100 credits have been used, are generally not eligible for a refund, except where required by applicable law.
If your request is eligible:
- The refund amount will be adjusted according to your actual credit usage.
- A service fee equal to 10% of the original payment amount will be deducted from the refund.
- Any credits, benefits, or paid features associated with the refunded subscription may be removed from your account.
To request a refund, contact support@crisp3d.ai using the email address associated with your Crisp3D account. Please include relevant purchase information so that we can review your request. Refund processing times may depend on the applicable third-party payment service provider and your payment method.
13. Third-Party Services
Crisp3D may use or provide access to third-party services, AI models, software, storage providers, payment processors, integrations, or external websites.
Third-party services may be governed by their own terms and privacy policies. Crisp3D does not control and is not responsible for the independent operation, availability, or content of those services. Your use of Input, Output, or third-party materials may also be subject to licenses or restrictions imposed by the relevant third party.
14. Privacy
Our collection and use of personal information are governed by the Crisp3D Privacy Policy. The Privacy Policy also explains how we handle account information, uploaded content, generated works, service data, and user privacy choices.
Any use of user content in connection with AI model training or improvement is governed by the Privacy Policy and any choices made available to you through the Service.
15. Feedback
If you send us suggestions, ideas, feature requests, or other feedback, you grant Crisp3D permission to use that feedback without restriction or compensation. Providing feedback does not give Crisp3D ownership of your Input or generated works.
16. Copyright Complaints
We respect the intellectual property rights of others. If you believe content available through Crisp3D infringes your copyright or other intellectual property rights, contact us at support@crisp3d.ai with the subject line “Copyright Infringement.”
Please include:
- Your name and contact information.
- A description of the protected work.
- The location or link of the content in question.
- An explanation of why you believe the content infringes your rights.
- A statement that the information you provide is accurate and submitted in good faith.
- Your physical or electronic signature.
We may remove or restrict access to disputed content while reviewing a complaint. We may also suspend accounts involved in repeated infringement.
17. Suspension and Termination
You may stop using Crisp3D at any time.
We may suspend, limit, or terminate your access if:
- You materially or repeatedly violate these Terms.
- Your activity creates a security, legal, financial, or technical risk.
- Required payments cannot be completed.
- We are required to do so by law.
- Continuing to provide the Service is no longer reasonably possible.
Where appropriate, we may provide notice and an opportunity to resolve the issue. Serious violations may result in immediate action. Termination does not remove obligations or liabilities that arose before termination.
18. Service Availability
We work to keep Crisp3D available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable because of maintenance, updates, provider outages, technical problems, security incidents, or circumstances outside our reasonable control.
We may modify or discontinue parts of the Service as Crisp3D develops. Where reasonably possible, we will provide notice of material changes affecting paid users.
19. Disclaimer of Warranties
To the fullest extent permitted by law, Crisp3D and the Service are provided on an “as is” and “as available” basis. NEXLIMIT LLC does not guarantee that:
- The Service will always be available, secure, or free from errors.
- Every Output will be accurate, complete, original, or suitable for your intended use.
- An Output will meet a particular technical, artistic, manufacturing, legal, or commercial standard.
- Errors or defects will always be corrected.
- Generated content will qualify for intellectual property protection.
Your use of the Service and any Output is at your own discretion and risk. Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, NEXLIMIT LLC and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use Crisp3D. This includes loss of profits, revenue, business opportunities, goodwill, content, or data.
To the fullest extent permitted by law, the total liability of NEXLIMIT LLC arising from or relating to the Service will not exceed the amount you paid to Crisp3D during the twelve months before the event giving rise to the claim. These limitations do not apply where liability cannot be excluded or limited under applicable law.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless NEXLIMIT LLC and its affiliates, officers, employees, and agents from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising from:
- Your Input or public content.
- Your use or misuse of the Service.
- Your violation of these Terms.
- Your violation of applicable law.
- Your infringement of another person’s rights.
This section does not apply to claims caused by NEXLIMIT LLC’s own unlawful conduct where such liability cannot legally be excluded.
22. Governing Law and Disputes
These Terms are governed by the laws applicable to NEXLIMIT LLC and the Service, without limiting any mandatory consumer protections available in your country or region.
Before beginning formal legal proceedings, you and Crisp3D agree to make a reasonable effort to resolve the dispute by contacting the other party and allowing a reasonable period for a response. Any unresolved dispute will be handled by a court or other dispute-resolution body with jurisdiction under applicable law.
23. Changes to These Terms
We may update these Terms to reflect changes to the Service, business practices, legal requirements, or security needs. When changes are material, we may provide notice through the Service, by email, or by updating the “Last updated” date at the top of this page.
Your continued use of Crisp3D after updated Terms take effect means that you accept the revised Terms. If you do not agree to an update, you should stop using the Service.
24. General Terms
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our permission. NEXLIMIT LLC may transfer these Terms as part of a merger, acquisition, corporate reorganization, asset sale, or similar business transaction.
These Terms, together with the Privacy Policy and any terms shown at purchase, form the agreement between you and NEXLIMIT LLC regarding Crisp3D.
